While marijuana is still classified as a schedule 1 drug federally, medical and recreational use is growing as more states legalize it. In places like Colorado, tax and fee revenue from the ‘drug’ has reached billions of dollars.

What does that have to do with you and your business?

Simply put, not only is it generating quite the income on a per state (and federal, albeit still illegal) basis, state courts are starting to be more supportive of the user than they are of the local business drug policy.

Your policy may state drug use can lead to termination. However, if your state has decriminalized marijuana, many employers are finding that firing over a failed drug screen is no longer simple.

If you find yourself in a legalized state, now may be the time to revisit your drug policy. The next time you fire someone for using marijuana, it may turn into a court battle you cannot win.

Like alcohol use, it is beginning to fall under a legal gray area. Use is allowed, as long as you don’t come to work smelling like you drank/smoked your whole stash!
